Blue Car Hire Terms and Conditions

Prepayment 

• Prepayment is payable to Blue Car Hire.
• Balance is payable to the car rental company directly 

Cancellation Administration Charge

• No refunds payable on deposits for bookings cancelled at less that 48 hours from the rental start time: (MPV – 7 seater require longer notice).
• No refunds payable on deposits for MPV – 7 seater bookings cancelled at less than 72 hours from the rental start time.
• All cancellation must be made in writing, emailed to cancellations@bluecarhire.com.

Period of Rental

• The duration of your rental starts and finishes according to the pick-up and drop off dates and times detailed on your confirmation email. The price will be confirmed at the time of booking and is calculated on the basis of 24 hour units.
•  If you wish to extend the rental period after collection of the car, or if you return the car later than stated on your confirmation email, you will be charged locally at the local daily rate, which may be higher than our rates. Blue Car Hire should be contacted by telephone if you wish to extend your booking at their rates.  
• No refund of deposits are payable on cars returned early. 

Child Seats

• Child seats are mandatory in most countries and must be requested at the time of booking. Although instructions will be provided you will be required to fit the child seat yourself. For older children, it is recommended that you take your own booster seats.

Out of hours Charges

• In most locations flights will be met and cars supplied outside of normal working hours. However there may be an additional charge for this service payable locally. This will be quoted when your flight times are given to us.
• In the event that a flight is delayed, causing the car pick-up to fall outside normal working hours, the additional charge may be made locally, where the out of hours service is available. It is likely in the UK that no charge will be made in these circumstances if a flight number has been provided. Staff will not normally wait on for you if they do not have a flight number.
• Blue Car Hire can accept no further responsibility where there is no out of hours facility available and it is therefore recommended that customers should take independent travel insurance.  

Driving Licence

• Drivers must produce a full valid driving licence held for at least one year (or in some cases an international driving licence). Drivers with a new style licence must have all sections with them.
• In certain locations and for some car types, drivers must have held a full licence for a minimum of 2 years.
• It is the driver’s responsibility to ensure that he/she has the appropriate driving licence.
• Blue Car Hire must be informed on any endorsements on the driver’s licence, as we may not be able to take your booking.
• No refunds will be given for rentals rejected due to non-production of a driving licence or non-disclosed endorsements.
• Fax or photocopied licences are not acceptable.

Rental Documents

• A printed booking confirmation email must be presented when picking up your rental car. Blue Car Hire cannot be held responsible for rentals rejected if a confirmation email is not present.
• You should retain your rental documents and related receipts for a minimum of 28 days after returning home.

Additional Drivers

• Charges often apply for additional drivers and are payable locally on pick-up. Blue Car Hire cannot be held responsible for any increase in charges. Please check with Blue Car Hire at time of booking.
• Additional drivers need to produce their driving licence in person at the branch and show additional identification eg passport.

Deposits – Insurance and Fuel

• Deposits vary by destination.
• All customers will be required to leave a deposit to cover the insurance excess and fuel. To do so, a valid credit card in the name of the lead driver, must be produced upon collection of the car, as a form of deposit.

• Where a deposit for fuel is payable, it will usually be refunded if the car is returned with a full tank.  If the tank is not returned full, our local car rental partner will charge for fuel at its prevailing rate. They may also levy a refuelling charge. Please check the fuel policy when you pick up your car.
• Deposits against damage are required in some countries. A major credit card can be used for this purpose.  

Provision of Cars

• Our local car rental partner can refuse to provide a car to any customer who is, in their opinion, unfit to drive or does not meet eligibility requirements. In such circumstances your contract with us will terminate immediately, and we will have no further liability to you, and no refund will be due.

Number of Passengers

• Our rental cars are insured for a maximum number of passengers. Blue Car Hire cannot accept responsibility if the vehicle is not large enough to fit all passengers and luggage on arrival if details were not supplied at the time of booking. In the interest of safety this number must not be exceeded and if exceeded the insurance will be invalidated.

Driving Restrictions

• Restrictions are applicable when crossing country and state borders. Please consult Blue Car Hire at the time of the booking as to whether border crossing is permitted and what, if any, charges apply.

Tax

• All taxes are included except those on any extras purchased locally, eg one-way drop off fees, child seats and additional drivers.
• Blue Car Hire reserves the right to levy any government increases in local taxes that may be introduced after the printing of these terms and conditions.
• Any additional charges payable on arrival are subject to local taxes at the prevailing rate in that country.

Car type / Suitability

• Blue Car Hire are unable to guarantee a particular make, model or fuel type of car. The car shown on your booking is for guidance only and may be substituted for an alternative, similar or upgraded car (at no extra cost).
• If you have booked a prestige car, the specific car booked is guaranteed.
• If it becomes impossible to provide your booked car due to breakdown or accident, a similar or upgrade car will be provided.
• If you are dissatisfied in any way with the standard of your booked car, you must advise our local car rental partner immediately and Blue Car Hire in writing within 28 days of your return.

Mechanical Difficulties / Accident

• In the event of any mechanical difficulties or accidents involving your car, it is important that the details are reported to our local car rental partner within 24 hours.
• In the event of an accident you must also complete an accident report form by the end of rental period.
• Local police should also be notified in the case of accidents and signed police report obtained.
• Full details of third parties should also be obtained.
• Our local car rental partner must give authority to repair or replace a vehicle. Their name and contact details are shown on your confirmation booking and rental agreement.
• You should retain copies of all rental documentation in the event an insurance company is involved.
• Your insurance cover may be invalidated if this procedure is not followed correctly and this may prejudice any claim for compensation.
• A check in form must be signed on return of the vehicle. Failure to do so may delay the investigation of disputes regarding damage excess charges. 

Complaints

Blue Car Hire aims to resolve complaints within 28 days of receipt. If the complaint is made specifically about our car rental partner we will endeavour to assist you in resolving that complaint.

Blue Car Hire is not responsible for changes in rental company charges to additional purchases made at the rental location. These would include additional drivers, child seats,  fuel and special equipment.

General Conditions

• All bookings by our customers are subject to our terms and conditions.
• The customer acknowledges that in making a booking with Blue Car Hire he / she does so only on the basis of the material contained on our website, booking email or information provided on the phone by its employees.
• Blue Car Hire acts as a Car Rental Broker and agent for various independent rental companies in the countries in which it operates. Booking made through Blue Car Hire is subject to these terms and conditions. Please note that the rental of the vehicle will be subject to the law of the country in which it is supplied to you and for this reason you will be required to sign a rental contract with the rental company which supplies the vehicle. You should satisfy yourself that you understand (and agree) to its terms and conditions, as you will be subject to, and must comply with these terms and the local law.
• Blue Car Hire cannot accept liability for any charges incurred on documentation signed for and accepted locally.
• Blue Car Hire will not be held responsible for any one driving under the influence of alcohol / drugs, causing wilful damage, off road driving or driving without due car and attention. The customer will accept responsibility in respect of such claims. This list is not exclusive. 

How a Contract is formed with Blue Car Hire

·        The way in which a contract is formed, for the purchase of car rental, is basically the same whether you book over the phone or via our website. However you choose to book, it is important to understand how and when a contract is formed.

·        The technical steps required for a contract to be formed are as follows: - When we quote prices over the telephone or place products on our website we are inviting you to make an offer for their purchase. You do not make this offer until you do so verbally or by pressing Reserve Car. You have made Blue Car Hire an offer to purchase the products one you have either pressed Reserve Car or done so verbally. Blue Car Hire will then accept this offer when it has both received the booking deposit and has sent you your confirmation email. Once done there is a binding contract between you and Blue Car Hire for this product.

·        Prior to making a booking and if you are unsure of anything related to the arrangements being made you can call one of our customer service staff.

Consequential Loss

• Blue Car Hire are responsible for losses you offer as a result of Blue Car Hire breaking this agreement if the losses are a foreseeable consequence of Blue Car Hire breaking the agreement. Losses are foreseeable where they could be contemplated by the both you and Blue Car Hire at the time our agreement is formed. Blue Car Hire are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and Blue Car Hire (such as loss of profits or loss of opportunity).

Force Majeure

• Blue Car Hire shall not be liable itself or vicariously through its local car rental suppliers for either a failure to perform or delay in performing any of its obligations under or pursuant to this booking, confirmation email, reservation, rental or terms and conditions, if and in so far as performance is delayed, hindered or prevented by force majeure, which expression shall mean any event beyond the reasonable control of the party in question. In the event that the force majeure persists for more that 14 consecutive days, Blue Car Hire may terminate and withdraw this booking, reservation or rental by giving 14 days notice to the clients original billing address.
• All prices on our website apply at the time of printing (January 2006) but we reserve the right to change any of these prices from time to time. Prices can go up or down. Please check our website for all up to date prices and services.  
  
   
  Terms and Conditions re Use of the Site and Page Creation 
• You undertake:
  not to use the Material for any unlawful purpose;
  not to use the Site in a manner which constitutes a violation or infringement of any person, firm or company (including but not limited to rights of copyright or confidentiality);
  not to make any use of the Site so that the Site is interrupted, damaged, rendered less efficient, or the functionality of the Site is in any way impaired;
  not to use the Site for the transmission or posting of any computer viruses or any material which is defamatory, offensive or of an obscene or menacing character, or in such a way as to cause annoyance, inconvenience or alarm;
  not to use the Site to transmit any material for the purposes of publicity, promotion and/or advertising without the prior written consent of Blue Wheels Ltd;
  that in the event that you may have any right, claim or action against any other user arising out of the use of the Site you shall pursue such right, claim or action independently of, and without recourse to, Blue Wheels Ltd
  to indemnify and defend Blue Wheels Ltd against all claims, liability, damages, costs and expenses, including legal fees, arising out of a breach of these Terms of Use or any use of the Site or the Material.
  Blue Wheels Ltd shall have the right to immediately suspend your access to the Site if a breach of these Terms of Use is committed.
  Content
• Blue Wheels Ltd accepts no liability with respect to any of the services, products, material or information offered or provided by businesses or organisations listed on, or linked to, this Site. Should you decide to contract with any of these businesses or organisations, the contract will be directly between you and the relevant business or organisation. Blue Wheels Ltd will have no contractual involvement, and will not be liable in contract or otherwise for any services, products, material or information provided to you by any of these organisations. Nor does Blue Wheels Ltd endorse any of those businesses or organisations or any of their products or services.
• Please note that, although these businesses or organisations have attempted to ensure that information and/or prices provided through the Site are accurate, they are not legally binding in any way.
• Terms and Conditions
• Bluecarhire (Blue Wheels Ltd) reserves the right to change these Terms of Use and any other Terms and Conditions contained elsewhere on the Site at any time. It shall be your responsibility to check the Terms of Use and/or Terms and Conditions regularly to ensure that you agree to any such amendments. If you do not agree to any changes please discontinue use of the Site immediately.
  Your Account
• If you use the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner. 
• Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update much of the information you provided us with in the Login area of the website. 
• Blue Wheels Ltd reserves the right to refuse access to the website, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.
• Licence for website access
• Blue Wheels Ltd grants you a limited licence to access and make personal use of this website, but not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Blue Wheels Ltd. This licence does not include any resale or commercial use of this website or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this website or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.
• This website or any portion of this website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent.
• You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Blue Wheels Ltd and its affiliates without express written consent. • Events beyond our reasonable control We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights. 
• No Warranty
• BlueCarHire.com is provided on an "as is" and "as available" basis and in particular does not warrant that the Site will continue to be available to you in either its current format or from its current domain name; the material contained on the Site will be true, accurate or complete in all respects; and the Site or any software available from the Site will be free from viruses or defects, except always to the extent otherwise set out in the Terms and Conditions and/or Terms of Use and to any warranties which are implied by law (including without limitation, warranties as to satisfactory quality and fitness for a particular purpose).
• Disclaimer
• Whilst every endeavour has been made to ensure that the information on the Site is true and fairly stated at the time of publication, no liability is accepted for error or omission.
• Blue Wheels Ltd accepts no responsibility for any transactions that take place between businesses and clients.
• Liability
• Blue Wheels Ltd shall not be liable for any direct, indirect or consequential loss or damage (including, without prejudice, any lost business opportunities, loss of profit or goodwill) arising from or in any way connected with the Site, or your inability to use the Site; with the exception of death or personal injury arising from the negligence of Blue Wheels Ltd.
